STATEMENT OF CLAIM

Paragraph 23 of Mr. McKillop’s accompanying Affidavit, claims that; “While the Respondent stated in his email to the applicant that it is not his intention to impugn the Applicant’s character, that is clearly a motivation for the Respondent as demonstrated by the various accusations he has made in relation to the Applicant.” That of course is simply not true.  Exploring the truth, has nothing to do with impugning character.  My statement that I don’t intend on impugning character, can be taken as a given. I have no particular ability in law and absolutely no formal training.  The disclosure issue dealing with an occurrence on April 17th, 2002, forced me to go without counsel. Since I will be calling no witnesses that could be considered friendly, I will try and ask simple questions & will allow for a response if the individual feels that the yes or no, is inadequate.  My monotone will never change and I will not take cheap shots, even if I am given a lawful opportunity.  Whether a witness cooperates or evades, it is their choice.  This case is so well documented, that it will be nearly impossible for either the Crown or the defence, to spin anything. I will confront no witness with any discrepancy, I will instead use my opportunity when I testify to correct the record with the facts and in some cases, support those facts with documents.  If Mr. McKillop feels that the truth will leave his character tarnished, he is correct.  But it is not my intention to impugn anyone. I will leave that type of behaviour to his ilk.

The Crown recently made the following statement regarding a settlement with the Ross twins. The fact that Mr. Don McKillop often ridiculed the allegations contained within both Q.B. 271 & 504, with his usual line that they were scandalous, frivolous & vexatious, is telling.  He had the files in his office and at all times knew the truth. Even the MAFIA lawyers aren’t allowed to mislead a court when they have personal knowledge that their client actually committed a particular act.  While a private practice lawyer is not required to turn in said client, his profession demands that he must withdraw.  Mr. Don McKillop, Q.C. did neither, even though his position as a Crown Counsel, should have had him turning over the information to the Director of Public Prosecutions, the very man who had ordered that the files be sequestered.
